Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and AutoTickers ("AutoTickers", "we", "us", "our"), a company registered in the Republic of Azerbaijan, governing your access to and use of the AutoTickers website (autotickers.com), mobile applications, and all related services (collectively, the "Platform").

By performing any of the following actions, you confirm that you have read, understood, and unconditionally agree to be bound by these Terms and our Privacy Policy:

• Creating an AutoTickers account.
• Posting, editing, or renewing any vehicle, bike, or parts listing.
• Contacting a buyer or seller through the Platform.
• Browsing or searching the Platform as a registered user.
• Purchasing any premium service or feature offered by AutoTickers.

If you do not agree with any part of these Terms, you must not use the Platform. Your continued use after we publish updated Terms constitutes acceptance of the revised Terms.

AutoTickers is an online classifieds advertising platform for the automotive market in the Republic of Azerbaijan. We provide technology that enables private individuals, licensed car dealerships, and automotive parts and accessories retailers to post advertisements ("listings") and connect with prospective buyers.

AutoTickers is not a dealer, agent, broker, or party to any vehicle transaction. We do not own, possess, inspect, certify, or guarantee any vehicle, motorcycle, or part listed on the Platform. We do not handle, hold, or process money on behalf of buyers or sellers in connection with vehicle transactions.

Any transaction for the purchase or sale of a vehicle, motorcycle, or part is a private agreement directly between the buyer and the seller. AutoTickers has no responsibility or liability in connection with such private transactions, except as expressly stated in these Terms.

To register an account and use the Platform, you must:

• Be at least 18 years of age.
• Have full legal capacity to enter into binding contracts under the laws of the Republic of Azerbaijan.
• Not have been previously suspended or permanently banned from AutoTickers.
• Provide accurate, complete, and current information during registration and at all times thereafter.
• Not be prohibited from using online marketplaces or classified services by any court order or applicable law.

Business users: If you register on behalf of a car dealership, parts retailer, leasing company, or any other legal entity, you represent and warrant that you have full authority to bind that entity to these Terms, and that the entity's details provided during registration are accurate.

Professional sellers: If you are a commercial seller — meaning you regularly offer vehicles or parts for sale in a business capacity — you must register as a Showroom (dealer) or Retailer account. Using an Individual account for commercial selling purposes is prohibited and constitutes a material breach of these Terms.

4.1 Account types

AutoTickers offers three account types:

• Individual: For private persons buying or selling their own personal vehicles or spare parts. Individual accounts are not permitted for commercial sales activity.
• Showroom (Dealer): For licensed car dealerships and commercial vehicle traders selling new or used cars, motorcycles, commercial vehicles, or other motorised vehicles as a business. A valid trade licence or business registration is required.
• Retailer: For businesses selling automotive parts, tyres, accessories, and aftermarket products. Business registration documentation is required.

4.2 Account registration

• You must provide a valid email address and mobile phone number that you own and control.
• You must verify your email address and phone number before your first listing is published.
• Each individual or business entity may maintain only one active account of each type.
• Creating duplicate accounts or using another person's identity is strictly prohibited.

4.3 Account security

• You are solely responsible for maintaining the confidentiality of your account credentials (username, password, and verification codes).
• You must notify AutoTickers immediately at [email protected] if you suspect any unauthorised use of or access to your account.
• AutoTickers will never ask for your password by email, phone, or any other communication channel. Any message requesting your password is fraudulent.
• You are responsible for all activities that occur under your account, whether or not you have authorised those activities.

5.1 General listing requirements

Every listing posted on AutoTickers must meet the following requirements. By posting a listing, you represent and warrant that:

• The listing is for a genuine item that you have the legal right to sell or advertise.
• All information in the listing — including make, model, year, mileage, condition, price, photographs, and description — is accurate, complete, and not misleading.
• The vehicle or item is legally owned by you or by the business on whose behalf you are acting.
• The listed price is the actual asking price, with no hidden charges, dealer fees, or conditions not disclosed in the listing.
• All photographs depict the actual vehicle or item being sold and are current (taken within the last 60 days for new listings).
• The listing represents only one item (no bundled or combined listings unless explicitly permitted by AutoTickers).

5.2 Vehicle listing requirements

• Mileage accuracy: The odometer reading disclosed in the listing must be accurate at the time of posting. Misrepresenting mileage — including knowingly listing a vehicle with a tampered odometer — is a criminal offence under Azerbaijani law and grounds for immediate permanent ban and referral to law enforcement.
• Accident and damage history: Any prior accidents, structural damage, flood damage, or fire damage must be clearly disclosed in the listing description. Failure to disclose known damage is fraudulent misrepresentation.
• Ownership status: You must confirm that the vehicle has a clear title — i.e., it is not subject to any outstanding finance or lien unless this is explicitly stated in the listing. Listing a vehicle under a finance agreement without disclosure is prohibited.
• Import and registration status: The import duty payment status, vehicle registration status, and whether the vehicle has passed the mandatory technical inspection (texniki baxış) must be accurately stated.
• VIN/chassis number: For vehicles over ₼5,000 in value, providing an accurate VIN or chassis number is mandatory to assist buyers in conducting vehicle history checks.
• Number of listings: Individual accounts may have up to 5 active listings at a time. Showroom and Retailer accounts may have up to the limit specified in their plan. Duplicate listings for the same vehicle are not permitted.

5.3 Parts and accessories listing requirements

• Parts must be accurately described by category, subcategory, compatible vehicle make(s) and model(s), condition (new / used / refurbished), and any applicable OEM or aftermarket part number.
• Counterfeit, non-standard, or safety-compromised parts (e.g., counterfeit airbags, non-approved brake components) are strictly prohibited and may be referred to the relevant regulatory authority.
• All photographs must represent the actual part being sold, not a stock image, unless the part is factory-sealed in original packaging.

5.4 Listing moderation

AutoTickers reserves the right to review, approve, edit, relocate, or remove any listing at our sole discretion for any reason, including but not limited to violation of these Terms, inaccurate information, suspicious activity, or legal compliance requirements. We may remove listings without prior notice. Repeated violations will result in account suspension.

5.5 Listing duration and renewal

Standard listings are active for 30 days from the date of posting and can be renewed for free. Featured and premium-position listings are active for the duration specified at the time of purchase. It is the seller's responsibility to remove listings for items that have already been sold. AutoTickers is not liable for contact received on listings that have not been removed after sale.

Purchasing a vehicle is a significant financial decision. AutoTickers strongly advises all buyers to exercise appropriate due diligence before completing any transaction.

6.1 Vehicle verification

• Ownership documents: Always verify the seller's identity against their national ID and confirm that the vehicle registration documents (texniki pasport) match the vehicle and the seller before paying any money.
• Vehicle history check: Use the vehicle's VIN or chassis number to conduct a history check through official Azerbaijani road authority (Dövlət Yol Polisi) records or a reputable third-party vehicle history service.
• Outstanding finance: Confirm that the vehicle is free of any outstanding loans, liens, or financial encumbrances before transfer of ownership. Purchasing a vehicle with outstanding finance without the lender's consent does not automatically transfer clean title to you.
• Physical inspection: We strongly recommend having any used vehicle inspected by a qualified and independent mechanic before purchase. AutoTickers does not conduct vehicle inspections and does not represent or warrant the condition of any listed vehicle.
• Test drives: Conduct test drives only in safe, public locations during daylight hours. Do not hand over any payment or deposit before completing your due diligence.

6.2 Payment safety

• Never pay a deposit or full payment before physically viewing and verifying the vehicle and the seller's ownership documents.
• Be cautious of sellers requesting advance payment by bank transfer, cryptocurrency, gift cards, or money transfer services before you have seen the vehicle — these are common fraud indicators.
• Conduct the final transaction in person at a safe, public location such as a bank, official registration office, or well-lit public car park.
• Always obtain a signed receipt or sale agreement when completing a transaction.

7.1 Accuracy and honesty

• Sellers bear full legal and moral responsibility for the accuracy of their listings. Misrepresenting a vehicle's condition, mileage, history, ownership, or legal status constitutes fraudulent misrepresentation and may result in civil liability, criminal prosecution, and permanent ban from the Platform.
• If a vehicle's condition changes materially after a listing is posted (e.g., following an accident), the seller must update or remove the listing promptly.
• Sellers must remove listings within 24 hours of a vehicle being sold.

7.2 Seller identification

• Sellers must be prepared to show a valid government-issued identity document (Azerbaijani national ID or passport) to any serious prospective buyer prior to a viewing.
• For vehicles valued above ₼10,000, AutoTickers may require identity verification before the listing is published.
• Dealer and Retailer account holders must maintain valid and current business registration and trading licences. AutoTickers may request updated documentation at any time.

7.3 Safe meetings

• Arrange viewings and test drives during daylight hours in publicly accessible locations where possible.
• Do not share your precise home address publicly. Use your city and district in your listing, and arrange a meeting point separately through the in-platform messaging system.
• For high-value transactions, consider meeting at a bank branch or official vehicle transfer office.

The following conduct is strictly prohibited on the Platform. Engaging in any of these activities may result in immediate account suspension, permanent ban, forfeiture of any fees paid, and referral to law enforcement authorities.

8.1 Fraudulent and illegal activity

• Listing stolen, cloned, unlawfully imported, or otherwise illegally obtained vehicles or parts.
• Listing vehicles with tampered, clocked, or otherwise manipulated odometers.
• Listing vehicles with forged, altered, or fraudulent registration documents or certificates of title.
• Using the Platform to facilitate money laundering, tax evasion, or any other financial crime.
• Impersonating a dealer, official government authority, or AutoTickers employee.
• Creating fake buyer enquiries or inflating listing views or engagement artificially.

8.2 Harmful and abusive conduct

• Harassing, threatening, abusing, intimidating, or discriminating against any user, buyer, seller, or AutoTickers employee.
• Using the Platform to collect personal data from users for unsolicited contact, spam, or data harvesting.
• Posting false, defamatory, or misleading reviews or comments about other users or their vehicles.
• Attempting to circumvent our anti-spam or anti-fraud detection systems.

8.3 Platform misuse

• Scraping, crawling, data-mining, or bulk-extracting any content from the Platform using automated tools, bots, or scripts without prior written consent from AutoTickers.
• Introducing viruses, malware, ransomware, spyware, or any other harmful code to the Platform.
• Attempting to gain unauthorised access to any part of our systems, servers, or databases.
• Attempting to circumvent, reverse-engineer, or otherwise tamper with our search ranking algorithms, listing management systems, or pricing tools.
• Using the Platform to solicit users to conduct transactions off-platform for the purpose of avoiding our fee structure.

9.1 Free basic listings

AutoTickers offers free basic listings for individual private sellers. Each Individual account is entitled to post up to 5 active listings at no charge. Dealer and Retailer accounts are subject to the pricing plan selected at the time of registration.

9.2 Premium features

AutoTickers offers optional paid features to increase listing visibility and reach, including:

• Featured listing: Places your listing prominently in search results and the homepage.
• Top placement: Pins your listing at the top of relevant category pages for a defined period.
• Additional photographs: Standard listings include up to 10 photographs; additional photo slots are available as a paid add-on.
• Verified seller badge: Displayed on listings from identity-verified sellers to build buyer trust.
• Social media promotion: Promotion of your listing on AutoTickers' official social media channels.

9.3 Payment terms

• All fees are displayed in Azerbaijani Manat (₼) and include applicable Value Added Tax (VAT) unless stated otherwise.
• Payments are processed securely by our PCI-DSS-compliant third-party payment provider. AutoTickers does not store full payment card numbers or CVV codes.
• Fees for paid services are non-refundable once the service has been activated, except where required by applicable consumer protection law in the Republic of Azerbaijan.
• If your payment fails or is reversed by your bank, AutoTickers may suspend the associated premium feature or listing until payment is resolved.

9.4 Fee changes

We reserve the right to modify our fee structure at any time. Changes will be posted on the Platform's pricing page at least 30 days before they take effect. Continued use of paid features after the effective date constitutes acceptance of the new fees.

9.5 No involvement in vehicle transactions

AutoTickers is strictly a classifieds advertising platform. We do not process, hold, escrow, or release any funds in connection with vehicle transactions between buyers and sellers. Any representation that AutoTickers is holding funds on your behalf is false and fraudulent.

AutoTickers provides an in-platform secure messaging system to facilitate initial contact between buyers and sellers.

• You may use the messaging system only for genuine enquiries related to listed vehicles or parts. Using it for spam, advertising, solicitation, or any purpose unrelated to a specific listing is prohibited.
• Do not share sensitive personal or financial information (e.g., national ID numbers, bank account details, credit card numbers) through the messaging system. AutoTickers cannot be held responsible for any loss resulting from doing so.
• AutoTickers may review messages for the purpose of fraud detection, safety investigations, and Platform compliance. By using the messaging system, you consent to this monitoring. See our Privacy Policy for details.
• Abusive, threatening, or harassing messages are prohibited and may result in immediate account suspension. Users receiving such messages should use the "Report" function immediately.
• Phone numbers shared within listings are shown to buyers only when they click "Show Number". We recommend conducting all initial communications through the in-platform messaging system before sharing personal contact details.

11.1 AutoTickers intellectual property

All intellectual property on the Platform — including but not limited to the AutoTickers name, logo, trade marks, website design, user interface, software, source code, databases, algorithms, and original editorial content — is owned by or licensed to AutoTickers and is protected by copyright, trademark, database rights, and other applicable intellectual property laws of the Republic of Azerbaijan and international conventions.

You may not copy, reproduce, distribute, modify, translate, create derivative works from, publicly display, publish, sublicense, or otherwise exploit any part of the Platform without our prior written consent, except as expressly permitted by applicable law.

11.2 Your listing content

You retain ownership of the content you post in your listings, including your vehicle photographs and written descriptions. By posting a listing, you grant AutoTickers a non-exclusive, worldwide, royalty-free, sub-licensable licence to use, display, reproduce, format, adapt, distribute, and promote your listing content for the purposes of:

• Operating and providing the classifieds service on the Platform.
• Promoting the Platform and your listings through marketing channels, including social media and email newsletters.
• Generating aggregated market intelligence and statistics (in anonymised form).

This licence ends when your listing is permanently removed from the Platform and all caches are cleared (which may take up to 14 days). You confirm that you own the rights to any photographs you upload and that they do not infringe any third party's copyright.

11.3 Reporting intellectual property infringement

If you believe any content on the Platform infringes your intellectual property rights, please submit a written notice to [email protected] including: your contact details, identification of the infringing material and its URL, and a statement of your good-faith belief that the use is unauthorised. We will investigate and respond within 10 working days.

AutoTickers is a passive classifieds advertising platform. By using the Platform, you acknowledge and agree to the following disclaimers:

• No verification of listings: Except where expressly indicated (e.g., "Verified Listing" badge), AutoTickers does not verify the accuracy, completeness, or authenticity of user-submitted listing content. Vehicle descriptions, photographs, mileage, condition, ownership, and price information are provided by sellers and are not independently verified by AutoTickers.
• No warranties on vehicles: AutoTickers makes no warranty of any kind — express, implied, or statutory — regarding any vehicle, motorcycle, part, or accessory listed on the Platform, including its condition, roadworthiness, legal status, or fitness for purpose.
• No warranty on platform availability: The Platform is provided "as is" and "as available". AutoTickers does not guarantee that the Platform will be continuously available, error-free, free from viruses, or uninterrupted. Scheduled and emergency maintenance may cause temporary downtime.
• Market pricing: Any valuation estimates, market price indicators, or pricing guides displayed on the Platform are informational only and do not constitute professional financial, legal, or valuation advice. Actual transaction prices may vary significantly.
• Third-party content: AutoTickers is not responsible for the content of external websites linked from the Platform, or for the practices of third-party services integrated into the Platform.

To the maximum extent permitted by the applicable law of the Republic of Azerbaijan, AutoTickers, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, contractors, and licensors shall not be liable for any of the following:

• Any loss or damage arising from your reliance on information in a vehicle or parts listing, including inaccurate descriptions, misrepresented mileage, undisclosed defects, or false ownership claims made by a seller.
• Any loss arising from a fraudulent transaction, scam, or deceptive practice carried out by another user of the Platform.
• Any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, or cost of substitute goods or services.
• Any loss arising from unauthorised access to or alteration of your listing content or account, provided we have exercised reasonable security measures.
• Any loss caused by temporary or permanent Platform outages, technical errors, or service interruptions.
• Any disputes between buyers and sellers that arise from or in connection with a vehicle transaction, test drive, or meeting arranged through the Platform.

Where liability cannot be fully excluded by applicable law, our total aggregate liability to you for all claims arising out of or in connection with these Terms or your use of the Platform shall not exceed the total fees actually paid by you to AutoTickers in the 12-month period immediately preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless AutoTickers, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, penalties, costs, and expenses (including reasonable legal fees and court costs) arising out of or related to:

• Your breach of any provision of these Terms or any applicable law or regulation.
• Any content you submit, post, or transmit through the Platform, including any claim that your listing content infringes the intellectual property or other rights of a third party.
• Any vehicle transaction conducted through or facilitated by the Platform between you and another user, including any dispute, injury, death, or property damage arising from a test drive or private sale.
• Your misrepresentation of your identity, account type, vehicle ownership, or the condition of any listed item.
• Your use of the Platform in a manner not authorised by these Terms.

15.1 Termination by you

You may close your account at any time by submitting a request to [email protected] or by using the account deletion option in your account settings. Upon closure, your active listings will be removed from public view and your personal data will be handled in accordance with our Privacy Policy. Any prepaid but unused premium features are non-refundable upon voluntary closure.

15.2 Termination by AutoTickers

AutoTickers may suspend or permanently terminate your account at any time, with or without prior notice, if:

• You violate these Terms, our listing policies, or any applicable law.
• We reasonably believe your account is being used fraudulently, to facilitate illegal activity, or to harm other users.
• We receive a lawful direction from a court, regulator, or law enforcement authority to do so.
• We decide to discontinue the Platform or a specific service, in which case we will provide reasonable advance notice.

Upon termination by AutoTickers for cause, all fees paid are forfeited and we may, at our discretion, pursue civil or criminal remedies.

15.3 Survival of terms

The following sections survive termination of your account and these Terms: Section 11 (Intellectual Property), Section 12 (Disclaimers), Section 13 (Limitation of Liability), Section 14 (Indemnification), and Section 17 (Governing Law). Termination does not affect any rights or obligations that accrued before termination.

AutoTickers shall not be liable for any delay or failure in the performance of its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, civil unrest, government actions, embargoes, power failures, telecommunications outages, cyberattacks, or other force majeure events. In such circumstances, we will make commercially reasonable efforts to restore service and notify users of any extended disruptions.

These Terms are governed by and construed in accordance with the laws of the Republic of Azerbaijan, without regard to its conflict of laws provisions.

17.1 Informal resolution

Before initiating any formal legal proceedings, you agree to contact AutoTickers at [email protected] and attempt to resolve the dispute informally. We will respond within 10 working days and endeavour to reach a fair resolution within 30 days of your initial contact.

17.2 Formal dispute resolution

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or in connection with these Terms, including their formation, validity, interpretation, performance, breach, or termination, shall be subject to the exclusive jurisdiction of the competent courts of Baku, Republic of Azerbaijan.

Nothing in this clause prevents either party from seeking urgent injunctive or other interim relief from any court of competent jurisdiction to prevent irreparable harm.

17.3 Disputes between users

AutoTickers is not a party to any transaction between buyers and sellers and has no obligation to mediate, arbitrate, or resolve any dispute between users. Users are encouraged to resolve disputes directly and may seek assistance from relevant consumer protection authorities or courts in the Republic of Azerbaijan.

AutoTickers reserves the right to amend these Terms at any time to reflect changes in our services, applicable laws, business practices, or for any other reason. When we make material changes, we will:

• Post the revised Terms on this page with an updated "Last Updated" date at the top.
• Send an email notification to all registered users at least 14 days before the revised Terms take effect.
• Display a prominent notice on the Platform for 30 days following publication of the revision.

Your continued access to or use of the Platform after the revised Terms take effect constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Platform and close your account before the effective date.

We encourage you to review these Terms periodically, at least every time you post a new listing.
